The short version: Doromir is provided free and as-is. It is a reflection tool, not medical advice. Your dreams are yours, and we have no access to them. And please do not rely on any phone alarm, including this one, as the only thing standing between you and something important.
1. Agreement
These Terms are an agreement between you and Nerdy Whiskers LLC ("we", "us"), covering the Doromir mobile application and this website (together, the "Service"). By installing or using Doromir you agree to them. If you do not agree, do not use the Service.
These Terms should be read together with our Privacy Policy, which is incorporated by reference.
2. Licence to use Doromir
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Doromir on devices you own or control, for your own personal, non-commercial use.
You agree not to:
- reverse engineer, decompile or disassemble the app, except where that right cannot lawfully be excluded;
- redistribute, resell, sublicense or rent the app;
- remove or obscure any proprietary notices; or
- use the Service in violation of applicable law.
We retain all rights in the app, its name, its logo and its design that are not expressly granted to you here.
3. Eligibility
You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher, to use Doromir. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or guardian.
4. Your content is yours
Everything you record, write or import into Doromir (recordings, transcripts, journal entries, tags and health figures) belongs to you. We claim no ownership of it and no licence to it.
We also have no access to it. Your content is stored on your device and is not transmitted to us, so we cannot read it, moderate it, back it up or restore it. You are solely responsible for keeping your own backups, and Doromir's export feature exists for that purpose. We are not liable for data lost through device loss, device failure, uninstalling the app, or clearing the app's data.
5. Doromir is not medical advice
Doromir is not a medical device and does not provide medical advice, diagnosis or treatment. Dream analyses, sleep correlations, themes, moods and any other insight the app produces are generated automatically for personal reflection. They may be wrong. They are not a clinical assessment of your sleep, your mental health or anything else.
Never disregard professional medical advice, or delay seeking it, because of something Doromir showed you. If you have concerns about your sleep or your mental health, consult a qualified health professional.
If you are in crisis or thinking about harming yourself, please contact your local emergency number or a crisis line in your country immediately. Doromir is not a crisis service, is not monitored, and cannot summon help. A dream journal can surface distressing material; if it does, please talk to someone who can help.
6. Alarms are not guaranteed
Do not rely on Doromir, or on any phone alarm, as your only alarm for anything that matters. Use a second, independent alarm for flights, exams, medication, work and similar.
Doromir schedules alarms through your operating system and does everything the platform allows to make them fire reliably. It cannot overcome factors outside its control, including but not limited to: the device being switched off, out of battery, or in a restricted power-saving mode; manufacturer battery optimisation or "app hibernation" features that suspend background apps; permissions being revoked; notification or volume settings; Do Not Disturb; the app being force-stopped or removed by the system; operating system updates and defects; and hardware failure.
We provide no warranty that an alarm will sound at the scheduled time, and we accept no liability for any consequence of a missed alarm.
7. Health integrations
Health features are optional. Where you connect Health Connect or a comparable health store, Doromir reads a limited set of records read-only, as described in our Privacy Policy. The accuracy of that data is determined by the device or wearable that produced it, not by Doromir, and sleep-stage estimates from consumer hardware are approximations. Doromir never writes to your health store. You can revoke access at any time.
8. Automatically generated content
Titles, tags, themes and reflections are produced by automated models running on your device. Automated output can be inaccurate, incomplete or nonsensical, and may misinterpret what you said. Treat it as a prompt for your own thinking, not as a factual statement about you. You can edit or delete any of it.
9. Third-party services
Doromir is distributed through app stores operated by third parties, whose own terms govern your download and any purchase. Optional on-device model downloads are served by third-party hosts under their own terms. Your device's speech recognition and health store are components of your operating system, governed by your device manufacturer's terms. We are not responsible for those services.
10. Availability and changes
The Service is provided on an ongoing but not guaranteed basis. We may modify, suspend or discontinue Doromir, or any of its features, at any time. Because your data lives on your device, discontinuation does not delete anything you have already recorded, but we may stop issuing updates, and future operating system versions may eventually render an unmaintained version unusable. Export your journal if you want a durable copy.
You may stop using the Service at any time by uninstalling the app.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free, or that any output will be accurate.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.
12. Limitation of liability
To the maximum extent permitted by law, Nerdy Whiskers LLC will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, goodwill or opportunity, arising out of or relating to your use of or inability to use the Service (including any missed alarm and any lost journal data), whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or US $25. Doromir is currently provided free of charge.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
13. Indemnity
You agree to indemnify and hold harmless Nerdy Whiskers LLC from any claim arising out of your misuse of the Service or your violation of these Terms or of applicable law.
14. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and the state and federal courts located there will have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally, which it may.
15. Changes to these Terms
We may update these Terms. When we do, we will change the effective date above and, for material changes, surface a notice in the app. Continuing to use the Service after a change takes effect means you accept the revised Terms.
16. Miscellaneous
If any provision of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms, with the Privacy Policy, are the entire agreement between you and us regarding the Service.
